What Else Should You Know About Divorce?

Fault Is Not an Issue in a Colorado Divorce

Colorado is a no-fault divorce state. This implies that there is no requirement for either spouse to allege wrongdoing by the other to initiate a divorce.

In a no-fault divorce state, a party only has to state that the marriage is “irretrievably broken” in order to proceed with a divorce, or “dissolution of marriage,” as it is referred to in Colorado. 

Are You a Colorado Resident? 

To be eligible to file for divorce in Colorado, at least one spouse must be a resident of the state and for a minimum of 91 days prior to filing.

How Long Do You Have to Wait?

Colorado has a mandatory 91-day waiting period from the time the divorce petition is filed and served to the other spouse before a divorce can be finalized.

However, it is not uncommon for the divorce process to extend beyond this period, depending on the complexities involved and the availability of the court.

Marital Property May Not Be Split 50/50

Colorado is an equitable distribution state. This means marital property will be divided in a manner that is deemed fair and equitable but not necessarily equal.

Will There Be Spousal Support?

In Colorado, spousal Support or Alimony are referred to as spousal maintenance.

This form of support is not guaranteed and depends on several factors, including the financial resources of each party, the duration of the marriage, and the standard of living established during the marriage.

Child Support Calculation

Child support in Colorado is calculated using a formula that takes into account both parents’ incomes, the number of overnight stays the child has with each parent, and any additional expenses related to the child.

Allocation of Parental Responsibilities 

The child custody process is referred to as the allocation of parental responsibilities (APR) in Colorado.

The court determines custody based on the best interest of the child, taking into consideration the child’s and parents’ preferences, the child’s adaptability to home, school, and community, as well as the mental and physical well-being of all parties involved.

The Requirement of Mediation

Most Colorado counties require parties to mediate before advancing to a court hearing with the hope that parties can resolve disputes, especially those related to parenting responsibilities, without going to trial.

Post-divorce, there is a possibility for modification of certain orders, such as child support, spousal support, and parenting time.
